Flint Confirmation Process Changes

Please note some changes to the Flint confirmation process - some to be instituted in February.
February changes deal with the timing of the hearings. The Court has requested we schedule status conferences as follows:
9:00
10:00
11:00
Contested hearing are:
9:30 Motions to Dismis
11:00 Motions for Relief
1:00 Confirmations
Any matters not resolved at the morning status conferences would be moved to the afternoon confirmation hearings. (Please let the Trustee’s office know if you have a preference to time for status conference and we will try to accommodate your request).
January changes deal with the electronic transmission of orders and resolution of contested hearings. Attached is the proposed procedure (very similar to the Detroit model). Here are the highlights:
- Applies only to confirmation matters.
- Debtor attorney would have to provide the OCP
- in all cases
- in electronic format
- to the Trustee
- six calendar days before the hearing
- with stipulations resolving objections.
- OCP w/confirmation hearing statement (CHS) must be submitted if there are unresolved issues (see attached).
- Status conferences would still be held.
- Failure to provide the OCP or CHS would mean appearance by the attorney at the status conference an at contested hearing docket - even if the case resolved at status conference.
- Trustee will submit all orders on confirmation matters.
- Minute entries for unconditional adjournments.
